All You Need to Know about the Medical Marijuana Laws in Florida


Florida is seeing a lot of debate surrounding medical marijuana these days. On the one hand people are pushing for the legalization of marijuana—and not just the medical variety—whereas on the other, people are discussing how many jobs the legalization of the recreational drug could bring. There’s also wide speculation about how the economy of the state will get a boost with the legalization of marijuana

However, until that happens, one just has medical marijuana to contend with, which has been legal in Florida for a few years now. The legalization expanded to allow people to smoke medical marijuana as well, this very year

But there’s so much more to the medical marijuana laws in Florida. Let’s take a look at them:

Smoking

Although the smoking of medical marijuana was deemed to be permissible in the state earlier this year, we suggest you be careful and refrain from doing it in public places. 

From 2017 onwards, smoking medical marijuana was banned in the Sunshine State. In 2019, a new bill repealed that ban, based on an overwhelmingly positive response from the people of Florida—70% people voted in its favor.

However, as of October 2019, smoking marijuana in public has been banned—and yes, this has come about only days after the state stopped prosecuting people for hemp.
All kinds of smoking and vaping are banned, and a violation will lead to a fine of $35, as well as community service of 10 hours.

Minimum Sentences


Judges now have more say on how a person charged for marijuana crimes will be treated. Based on their evaluation of the case and of the defendant, a judge can impose their own minimum sentences—in this case, a relaxed minimum sentence

This comes, of course, as a direct successor to the announcement by the state attorney that marijuana charges wouldn’t be pursued any longer.  

More Dispensaries

There’s more lenience on the part of the Florida Department of Health when it comes to providing licenses to dispensaries and private marijuana growers. The former limit of 25 facilities on one license is also being lifted according to this bill, which means that more medical marijuana can be grown and cultivated.

Even More Marijuana!

One Florida State bill is all set to revise how the state sees low-THC edibles and products, enabling more businesses to invest in and sell these products. Although for now it rests on retail facilities for medical marijuana, treatment centers and others are expected to be brought into the fold.
